The acting Chief Justice, Justice Paul Baffoe-Bonnie, has called on magistrates and judges to fiercely guard their independence from external pressures\u2014whether political, commercial, or social\u2014when handling cases related to illegal mining, drug trafficking, and abuse.<\/p>\n

Speaking at this year\u2019s annual general meeting of the Association of Magistrates and Judges in Accra yesterday, he said that although members of the judiciary were not policymakers and did not wield the enforcement powers of the executive, judges and magistrates remained the guardians of justice, custodians of the law, and interpreters of the nation\u2019s conscience.<\/p>\n

\u201cWe must ensure that prosecutions related to illegal mining and drug trafficking and abuse are handled with seriousness, impartiality, and urgency. And I mean urgency,\u201d he stressed.<\/p>\n

\u201cWhere there is evidence, the law must be applied without fear or favour. No person\u2014and I mean no person\u2014regardless of their political affiliation or social status, should be immune from justice,\u201d he added.<\/p>\n

The two-day conference is on the theme \u201cLeveraging Technology to Enhance Justice Delivery.\u201d<\/em><\/p>\n

Among the issues being deliberated on are the challenges and opportunities confronting judges as stewards of justice. Members of the association will also elect new leaders.<\/p>\n

Harmonisation<\/h3>\n

Justice Baffoe-Bonnie further urged the bench to work towards harmonising sentencing practices to ensure propriety, deterrence, and fairness. He emphasised, \u201cWe must fiercely guard our independence from external pressures, be they political, commercial, or social.\u201d<\/p>\n

\u201cThe fight against illegal mining and drug abuse cannot be won by the judiciary alone, but it cannot be won without us either. Let us not underestimate the ripple effect of our judgments, our diligence, and our courage. Every ruling grounded in justice strengthens the foundation of a law-abiding society,\u201d he noted.<\/p>\n

He observed that the destruction of arable land and contamination of the country\u2019s water bodies had directly impacted agricultural productivity, leading to low food production, food price hikes, and adverse effects on the health of people in affected communities.<\/p>\n

An estimated 4,726 hectares of land have been destroyed in 34 out of the 288 forest reserves across seven regions.<\/p>\n

Drug abuse<\/h3>\n

On drug abuse, the acting Chief Justice cited a study which found a relatively high rate of substance use among adolescents, with a prevalence of 12.3 per cent.<\/p>\n

The study further revealed that 56.9 per cent of adolescents in the country abuse alcohol, while 36.4 per cent abuse cigarettes.<\/p>\n

He announced plans to collaborate with relevant authorities to refine the specialised courts created during former Chief Justice Georgina Theodora Wood\u2019s tenure, and to create or designate additional courts to deal with the increasing number of cases involving gun violence, environmental degradation, and drug-related offences.<\/p>\n

Commitment<\/h3>\n

The Attorney-General and Minister of Justice, Dr Dominic Ayine, said the government was committed to modernising the judiciary through the use of technology to enhance efficiency.<\/p>\n

He commended the leadership of the association for embracing technology in justice delivery.<\/p>\n

Dr Ayine noted that prolonged adjournments and case backlogs eroded public confidence, and therefore called for the expeditious handling of judicial matters.<\/p>\n

He, however, cautioned that while technology offered significant benefits, it must be used responsibly.<\/p>\n

\u201cJudges must be open to new methods, lawyers must adapt their practices, and the state must ensure adequate resources are made available,\u201d Dr Ayine said.<\/p>\n

Challenges<\/h3>\n

The President of the association, Justice Henry Anthony Kwofi, said the effective use of technology would streamline court processes, reduce paperwork, and improve efficiency, ultimately leading to faster case resolutions and enhanced public satisfaction.<\/p>\n

Reflecting on the challenges faced by the judiciary, Justice Kwofi expressed concern over inadequate resources and support for judges.<\/p>\n

He cited issues such as unpaid allowances, lack of vehicles, and insufficient medical support, which he said were \u201cmaking the work of judges extremely difficult.\u201d<\/p>\n<\/div>\n
