Nottingham Forest have failed with an appeal against their four-point punishment for breaching Premier League profit and sustainability rules (PSR).<\/p>\n

The club\u2019s case was held on 24 April and an appeal board has upheld the original decision of an independent commission to impose the sanction.<\/p>\n

The commission found Forest\u2019s losses to 2022-23 breached the threshold of \u00a361m by \u00a334.5m.<\/p>\n

It means Forest remain 17th and three points clear of the relegation zone with two games left to play.<\/p>\n

The three-person appeal board arrived at a \u201cunanimous\u201d decision to uphold the original ruling by the commission, describing it as \u201ccommendably clear and comprehensive\u201d.<\/p>\n

\u201cSome of the criticisms of the [original] decision have involved a minute examination of the words used by the commission,\u201d the board said of Forest\u2019s appeal.<\/p>\n

\u201cDecisions such as these should not be subjected to microscopic forensic examination and interpreted as if they were statutes which have been drafted by parliamentary counsel.<\/p>\n

\u201cAllegations of infelicities of language or errors which are not material to the ultimate decision add to the complexity and costs of proceedings and are rarely likely to lead to a successful challenge of a decision.\u201d<\/p>\n

In March,\u00a0Forest dropped into the Premier League\u2019s relegation zone\u00a0after the initial points deduction.<\/p>\n

The Premier League\u2019s profit and sustainability rules permit clubs to lose \u00a3105m over three seasons \u2013 or \u00a335m per campaign \u2013 but Forest\u2019s maximum loss was limited to \u00a361m as they spent two years of the assessment in the Championship.<\/p>\n

The club\u2019s net transfer spend in the 2022-23 season was \u00a3142.8m. They lost an average of \u00a33m across 2020 and 2021 with a further \u00a340m loss in 2022 and \u00a352m in 2023, amounting to a total of \u00a395m.<\/p>\n

Forest had been due to receive a six-point deduction \u2013 three points for the initial breach and a further three for the size of the breach \u2013 but their \u201cearly plea\u201d and \u201ccooperation\u201d saw the ban reduced to four points.<\/p>\n

Forest host Chelsea on Saturday (17:30 BST) and end the campaign at relegation-threatened Burnley (16:00 BST) on 19 May.<\/p>
