“Parents can label it as coercion when a teacher tells a student to apologize for a mistake,” Ham said. “Instead, I offer indirect choices, asking students if they want to apologize immediately or talk again in two hours \u2014 a compromise that leaves me feeling helpless.”<\/p>\n

Teachers have few structural defenses against malicious complaints from parents besides filing civil lawsuits for defamation or appealing to a regional committee under the education office that reviews violations of teachers’ rights. <\/p>\n

A first level response requires a written apology and a written promise not to repeat the behavior, while a second level response involves special education or psychological treatment. Often, committees take no action at all. Peer pressure also distorts the system. A Gyeonggi Province middle school teacher who handled rights protection duties said colleagues often feel forced to persuade innocent educators to yield to parent pressure and settle, out of fear that the dispute will trigger a formal child abuse investigation. <\/p>\n

Ham said parents increasingly exploit this power imbalance by threatening to file child abuse reports unless teachers withdraw their complaints from the rights protection committees.<\/p>\n

Teacher organizations are calling for urgent legislative reforms. Proposed measures include amending the Act on Special Cases Concerning the Punishment of Child Abuse Crimes so that police can drop cases immediately if education offices deem the instructor’s actions lawful classroom management.<\/p>\n

Educators are also seeking a revision to the Child Welfare Act to restrict emotional abuse clauses within school environments. However, primary ministries like the Ministry of Justice maintain a highly cautious stance, citing child protection and victim-centered legal principles. <\/p>\n

“Just as school playground noise and construction site noise are not the same, there is a need to consider the unique educational environment rather than applying the exact same standards of general administration to the educational field,” said Park Ju-hyung, a professor at Gyeongin National University of Education.<\/p>\n

Park said authorities must establish mechanisms ensuring that educational perspectives and institutional contexts are fully reflected in investigations of child abuse against a teacher.<\/p>\n
