Private legal practitioner Martin Kpebu has cautioned that while the National Democratic Congress (NDC) may apply for a review of the Supreme Court\u2019s ruling on the Kpandai parliamentary election, the chances of success are low.<\/p>\n

Speaking on Joy FM\u2019s Midday News on Wednesday, January 28, 2026, Mr Kpebu explained the Supreme Court review process.<\/p>\n

\u201cThey [the NDC] can apply for a review. In the Supreme Court, you effectively have two chances: first, at the ordinary bench, and if your case is dismissed, you can file for a review.<\/p>\n

However, most reviews do not succeed. Often, as lawyers, we may spot an obvious or glaring error, but it still fails to find favour in the court,\u201d he said.<\/p>\n

The comments follow the Supreme Court\u2019s 4\u20131 majority decision quashing the Tamale High Court judgment that annulled the election of New Patriotic Party (NPP) candidate Matthew Nyindam. The apex court cited jurisdictional errors and upheld Mr Nyindam\u2019s application, invoking its supervisory jurisdiction, effectively restoring him as Member of Parliament for Kpandai.<\/p>\n

Despite the ruling, the NDC insists the matter is not closed. Majority Chief Whip in Parliament, Rockson-Nelson Deafeamekpor, said the party was \u201cgrieved\u201d but emphasised that constitutional and legal avenues remain open.<\/p>\n

\u201cThis is not the end. This matter is not the end. The ruling of the court will be filed according to the court\u2019s own decision by February 6. When we obtain the certified true copy and study it, we will advise ourselves. There is a review option, so this matter is not the end,\u201d Mr Deafeamekpor stated.<\/p>\n
